The legal stuff looks a bit complicated, but don’t worry. Here at DBJ, we know that things don’t always go to plan. Below is a quick summary of our T&C to help you understand what happens then things don’t work out.
Returns: local hires are due back by midnight on the Sunday, unless agreed otherwise at the time of booking. Late fees are $10/day. Postal hires must be lodged at the post office before 3pm on the Monday.
Damages: in the event of minor accidents or damage, the customer is liable for the cost of repairs and cleaning. Cleaning of spills, excessive tan transfer or dirty dresses starts at $25. Minor repairs such as broken zips, torn straps or heel holes in a hemline typically cost $25 to $50.
Cancellations: changed your mind? That’s okay! Depending on the amount of notice given, you will be eligible for a partial refund or store credit.
Exchanges: we can exchange your hire for a $15 processing fee, plus any difference in the hire price.
Lost garment covers: oops! Forgot to return one of our garment protectors? We’ll need to charge $20. We’ll refund this if the cover is returned.
Replacement: in the rare event of a dress being damaged beyond repair, the customer will owe the RRP of the garment.
1.1 Dressed By Jess Hire: (“Dressed By Jess”, DBJ”, “DBJH”, “Us”, “We”, “Our”) defines Dressed By Jess Hire, owned and operated by Jessica Quinn trading as Jessica Quinn ABN
1.2 The Client: (“You”, “Your”, “Client”, “Borrower”) defines the person that enters into a rental agreement with DBJ.
1.3 The Garment: (“Garment”, “Garments”, “Clothing”, “Apparel”, “Accessories”, “Outfit”, “Dress”, “Item”) defines any and all clothing or accessories hired from DBJ by Client.
1.4 Rental Period: the agreed and pre-negotiated period of time that The Garment is being hired by Client.
1.5 Price: means the cost of hiring a garment from DBJ
1.6 Rental Return Due Date: defines the date the Apparel is expected back at DBJ’s location.
1.7 Rental Post Return Date: means the date the Apparel is expected to be lodged at an Australia Post Office.
1.8 Interstate: defines any Garment that is rented outside of Western Australia.
1.9 Location: defines the Location of the DBJ rental store, to be provided to Client after booking a Garment.
1.10 Public Holiday: defines a nationally recognised non-working day in Australia.
2.1 The rental price is calculated according to the rental period chosen by The Client and is inclusive of Goods and Services Tax (“GST”).
2.2 Payment of the rental price for online bookings is through Credit Card platforms (“Visa”, “Mastercard”) and must be made at the time the order is placed. DBJH is unable to process any orders until such payment is made and proof of payment is received.
2.3 Payment may also be made in cash or by card at the time of booking at the DBJ Location.
2.4 Once a Garment has been paid for in full, under no circumstances will a full refund be given (It is the responsibility of Client to try on the garment before booking in or have an understanding of their size requirements).
2.5 DBJ will securely store the card details of the Client until the Rental Period has ended. No extra charges will be made to this card if the Garment is returned in a condition and timeframe that is acceptable to DBJ to be determined at DBJH sole discretion.
3.1 If a cancellation is requested and greater than 2 weeks notice is given prior to the Event Date, the customer will receive a refund minus a 50% Cancellation Fee.
3.2 If a cancellation is requested and less than 2 weeks notice is given prior to the Event Date, the customer will receive a Store Credit less a 50% Cancellation Fee. Customers will not be eligible for a refund. Store credits are valid for 12 months and begin 1 day after the original event date.
3.3 If a change of date or an exchange is requested at any time, this can be actioned (subject to Garment availability) at the cost of a $15 Processing Fee.
3.4 In the event of an exchange, the difference in Hire Fee must be paid to DBJ if the new Garment is a higher price than the original Garment. If the new Garment is a lesser price than the original Garment, the customer will not receive a refund of the difference.
3.5 If a cancellation or exchange is requested after the garment has been collected from the DBJ premises, the customer will not be eligible for a refund or store credit. This includes but is not limited to circumstances such as event cancellation, the customer becoming unwell or a change of mind.
4.1 All Garments are to be returned on Day 4 of the Hire Period unless otherwise agreed in writing at the time of booking. Returns are to be lodged via the returns slot at the DBJ store, or at the front desk if the store is open.
4.2 Alternate arrangements for the return date can be made and agreed on in good faith with DBJ prior to the commencement of the Rental Period.
4.3 Late fees are applied if not returned by midnight Sunday. $10 per day is charged to the Client until the Garment is returned, payable in Australian Dollars.
4.4 The garment is deemed a non-return after 14 days and the client will be charged 100% of the Recommended Retail Price (“RRP”) as listed on the DBJ website, payable in Australian Dollars.
4.5 If a late return results in subsequent cancellation of an upcoming confirmed hire, the Borrower will be charged the full value of that hire in addition to late fees.
4.6 If a late return is such that it is not back before 4:30pm on the Friday, the full value of the hire fee will be charged again, less the late fees already charged. If not back by midnight the following Sunday, late fees of $10 per day will resume.
4.7 All Garments must be returned inside the garment cover bag they were received in. Lost garment covers will incur a charge of $20.
5.1 Garments being returned via post are to be posted on Day 4 of the Rental Period, or the next business day.
5.2 Garments must be lodged at an Australia Post Office or Australia Post Yellow Express Box before 1500 hours.
5.3 If a Public Holiday falls on Day 4 of the Hire Period, then the Garment must be lodged on the next business day before 1500 hours.
5.4 Garments must be returned in the packaging provided by DBJ, using the pre-paid postage label or satchel provided by DBJ.
5.5 Late fees are applied if the garment is not lodged correctly. Late fees are $10 per day.
5.6 If a late return results in subsequent cancellation of an upcoming confirmed hire, the Borrower will be charged the full value of that hire in addition to late fees.
5.7 The garment is deemed a non-return after 14 days and the client will be charged 100% of the Recommended Retail Price (“RRP”) as listed on the DBJ website, payable in Australian Dollars.
5.8 If a postal hire is delivered and does not fit, the borrower can request a store credit minus any postage costs and minus a $30 cancellation fee. The return request must be made on the same day that the parcel is delivered. The return must be made the same day as delivery, or the next business day. If the garment displays any signs of wear, including but not limited to tan, makeup, perfume or other smells, then no credit will be provided. The credit is valid for 3 years from the date of issue.
6.1 All cleaning of The Garment is taken care of by DBJ. By hiring The Garment the Client agrees that they will not attempt to clean the garment, doing so may result in a non-return fee to be paid.
6.2 The cost of cleaning is included in the hire fee, provided the garment is returned in reasonable condition. Major staining will incur extra charges, starting from $20.
7.1 It is expected that all Garments are returned in the condition that they were received by DBJ.
7.2 It is the responsibility of The Borrower to inspect The Garment after it has been collected or received. If the condition of The Garment is not satisfactory or any damages are noticed, The Borrower has 4 hours from the time of pick up to notify DBJ of said damages with photographic evidence. If the defects are deemed minor and in line with what is to be expected of a Hire Garment then The Borrower may continue with the hire. If DBJ deems The Garment to be unwearable then The Borrower is eligible for an exchange (where possible) or a full refund. The definition of Minor vs Major is at the discretion of DBJ.
If DBJ is not notified within 4 hours from the time of pick up or delivery of any damages then it will be assumed that The Borrower is satisfied with the condition of The Garment.
7.2 If a Garment is returned with minor damages, the client agrees to pay for the repair (in addition to the rental price). The price will be determined in good faith by DBJ in conjunction with DBJ’s seamstress and/or dry cleaning provider.
7.3 If a Garment is returned with major damages, either beyond repair or ruined determined at the discretion of DBJ, The Client agrees to pay the full replacement cost of the garment which will be determined in good faith by DBJ and may be up to but not above the RRP of the garment. This will be paid within 14 days of the Garment being returned.
7.4 It is at DBJH’s sole discretion to determine whether the damage is deemed “Minor” or “Major” as well as the repair cost
7.5 Refunds will be available if garments are received damaged as per Australian Consumer Law (beyond normal wear and tear of a hire garment). Clients recognise that they are wearing a second hand Garment that has been worn by other people. Thus, some wear and tear is to be expected. DBJ will not provide refunds for garments received that have normal wear and tear of a hire garment.
7.6 If a Borrower intentionally removes the hanging tags on a Garment, the Borrower will be charged a damages fee of $15.
8.1 Items purchased may be returned within 7 days from the date of purchase. Returns after 7 days will not be accepted.
8.1 The item must be in the same condition that the client received it in, unworn and unused, with tags attached and in its original packaging.
8.2 Refunds are in the form of a credit note only, valid for 6 months. Any shipping charges will not be refunded.
8.3 This policy does not apply to items purchased during Flash Sale or Promotional Periods. Returns are only accepted on full priced purchases.
8.4 This policy does not apply to hire garments.
